🚨 DEALERSHIP DISHONORS SECURED TRANSACTION – KNOW YOUR RIGHTS!🚨

⚠️ Are Car Dealers Ignoring Your Legal Payment Methods? ⚠️

A member of our freedom faith community used a Bill of Credit (BOC) from their living trust (98 number) to purchase a vehicle outright (NOT a financed deal). The dealer accepted the transaction, had them sign the window sticker, and the buyer perfected their lien in 20 days—officially securing their interest in the vehicle.

But NOW the dealer refuses to process the bill of credit, saying they won’t deposit it at the bank. 🚨 This is a dishonor between two creditors—and it’s happening more and more to those asserting their financial independence!

📌 The buyer properly assigned the BOC to the IRS, filed their UCC-1 and UCC-3 with the Secretary of State, and documented everything. Despite this, the dealership is ignoring the secured party’s rights.

📢 Question: What steps can be taken to legally enforce the transaction* before the UCC-1 filing expires?


🔥 KNOW YOUR ENFORCEMENT REMEDIES 🔥

💡 1. Demand for Performance & Notice of Dishonor
➡️ The refusal to process a valid financial instrument is a dishonor under UCC 3-505 & UCC 3-502.
➡️ Send a Notice of Dishonor via certified mail, demanding that they honor the transaction or provide a valid legal basis for refusal.

💡 2. File a UCC-9 Enforcement Claim

➡️ Under UCC Article 9, as a secured party, you can enforce your interest in the collateral.
➡️ File a UCC-9 Claim with the Secretary of State, demanding compliance.

💡 3. Issue a Notice of Protest
➡️ If the dealer fails to act, escalate with a Notice of Protest—a formal public record of dishonor.

💡 4. Demand for Specific Performance
➡️ Under contract law, the dealer cannot accept a payment instrument and then refuse to process it.
➡️ Send a Conditional Acceptance Letter, making it clear they must act or be held liable.

💡 5. Take Legal Action
➡️ If the dealer still refuses, you may file a **commercial claim for breach of contract and dishonor in small claims court or state court.
➡️ Attach:
✔️ UCC filings
✔️ Copy of the Bill of Credit
✔️ Certified mail correspondences
✔️ Dealer’s refusal statements

💡 6. IRS & Treasury Enforcement
➡️ If the BOC was assigned to the IRS, notify them of the dealer’s refusal to process an assigned instrument.
➡️ File an IRS Form 3949-A (whistleblower) or 1099-A (acquisition/abandonment of secured property)** if applicable.

💡 7. Notarial Protest & Private Administrative Judgment
➡️ If the dealer remains in dishonor after three notices, obtain a Notarial Protest & Administrative Judgment.
➡️ This can be converted into a UCC-9 Lien Enforcement and repossession order.

When we were younger,
